Wage & Hour Rights and Responsibilities
Wage Payment: Employee rights include:- Spend for all earnings made (INFO # 3) at the rate accepted by the company and worker.
– Pay of at least base pay (INFO # 1), the applicable Colorado or local base pay, and all earned overtime incomes without impermissible deductions from their earnings;.
– Pay of all made salaries without impermissible deductions (INFO # 16).
Labor Statutes, Rules, & Published Guidance
Statutes & Rules: job DLSS implements a lot of Colorado’s wage and hour and other kinds of labor statutes and labor guidelines, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Spend For Equal Work Act. Please visit the Division’s Labor Statutes and Labor Rules websites for existing and prior versions of crucial Colorado labor statutes and job guidelines.
Published Guidance: The Division’s primary kinds of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s formally approved notifications, opinions, and explanations on various labor law topics; and.
– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for staff members on their labor rights.
Written Demands, Complaints, & Investigations
Demands & Complaints for Wages: If an employer owes you salaries, you can send your company a composed need for payment of wages by mail, email, text message, or other electronic methods. A written demand might be sent to the company at the same time a Labor Standards Complaint Form for overdue incomes is filed with the Division. The Labor Standards Complaint Form can be discovered on our Demands, Complaints, Responses, and Settlements webpage.
Employer Responses in Investigations: Once a complete Labor Standards Complaint Form is received and reviewed, a letter discussing the nature of the problem and the quantities declared to be owed is sent out to the employer. Investigations Launched by the Division (” Direct Investigations”): The Division might perform employer-wide direct examinations of prospective offenses of Colorado wage and hour law. If you would like to submit a tip, please email the Division at cdle_di_tips@state.co.us. If you want to submit an individual claim for unsettled incomes, you should complete a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct investigation citation or one or more Notices of Assessment, a supposed company may submit a Direct Investigation Appeal Form.
